haha, ok, I know you have a heated rant in store for me, but please keep the banter somewhere else, no matter what side you’re on. My questions have more to do with the practice of government than whether or not we have an effective policy.

My questions are, what country’s health care system is most comparable to the one the US will be adopting. Certainly we had to have a template to work off of.

Also, Obama passed an executive order saying that abortion will not be funded by the new health care. I hear a lot of people saying that executive orders “mean nothing.” Is that really true? I mean, give examples, don’t just tell me what Glen Beck or Keith Olbermann told you.

The Executive Order DOES mean nothing, because federal funding of abortion is already illegal.

It would be like signing an executive order stating “rape is still illegal”. It is meaningless.

Colonel James L. Pohl is an American lawyer and an officer in the United States Army.

He is notable for having been appointed the President of a Guantanamo military commission. He is Presiding over the Commission of Ahmed Darbi and Abd el-Rahim al-Nashiri. He is notable for serving as the judge of several of the GIs in the Abu Ghraib torture and prisoner abuse cases, and barring the demolition of Abu Ghraib because he had ruled it a crime scene.

On 6 January 2009 Pohl was appointed to replace Ralph Kohlmann as the Chief Presiding Officer for the Military Commissions.

—->>>On January 29, 2009, Pohl denied the request of the Obama Administration to delay proceeding for 120 days in the case of Abd al-Rahim al-Nashiri. Pohl argued that tribunal rules give the judges sole authority to delay cases and that postponing proceedings against Abd al-Rahim al-Nashiri was not reasonable and “does not serve the interest of justice”.

According to Carol Rosenberg, writing in the Miami Herald, Pohl’s ruling stated:

“The Commission is bound by the law as it currently exists not as it may change in the future.”

“The public interest in a speedy trial will be harmed by the delay in the arraignment.”

According to Guantanamo spokesman Commander Jeffrey Gordon:

“The Department of Defense is currently reviewing Judge Pohl’s ruling. We will be in compliance with the president’s orders regarding Guantánamo.”

According to Fox News, Pentagon spokesman Geoff Morrell said that “Pohl will be directed to comply with Obama’s executive order.”

The arraignment could be canceled, even if Pohl continued to assert his duty lay in ignoring Obama’s order, if either Susan J. Crawford the Convening Authority for the Office of Military Commissions, or Al Nashiri’s prosecution, withdrew the charges.

So, do you agree with the Colonel’s decision and how smart is it for an Army officer to disobey a presidential order?

Regardless of your thoughts on the matter, it seems pretty cut and dried. A lawfully elected commander and chief gave an order and this colonel seems to be saying it was an illegal order and therefore he will not follow it.

Based on the short summary there, and the statements made by the pentagon, the military intends to remain correctly subordinate to the elected politicians and will carry the order out, so that pulls the carpet as to it being an illegal order.

As regards the specific case, maybe he is right, maybe he is wrong, but once you get to a rank like his, the options are clear. Either follow legally given orders or resign, it’s that simple in a civilized country.

“President Obama’s proclamation on Monday that he “can’t wait” for congressional action to help underwater homeowners raises two questions.

If he already had the legal authority to take action, then why did he wait?

Some may frame the second question this way: does Obama’s plan exceed his constitutional authority? Perhaps the better way to ask the second question is whether the Obama plan is unlawful.

He also made 3 recess appointments, one of which the congress does not approve of the position rather than the appointee.

Do you people read his executive orders? I didn’t think so or it would make you think twice about the trust you have put in him above your own elected representatives. HE has made congress his enemy rather than deciding to give them the respect of working with them. You DON’T declare congress your enemy and then go SOLO. That, my friends, is a DICTATORSHIP. Want it? Move. What do you believe his “fundamental transformation” of your country means?
